1. These terms

These terms govern your use of the Alani app, this website, and anything else Alani Jones Foundation offers through them. In these terms, "the Foundation", "we" and "us" mean Alani Jones Foundation, and "you" means the person using Alani.

By using Alani you accept these terms. If you do not accept them, please do not use it.

2. Alani is not medical care

This is the most important thing on this page, so it is near the top rather than buried in a section about warranties.

Alani is written support content, a private journal, and a place where bereaved parents talk to each other. It is not therapy, not counseling, not medical advice, and not treatment. The Foundation is not a healthcare provider and using Alani does not make anyone here your clinician. Nothing in Alani should be used to decide whether to seek care, to delay it, or to start or stop a medication.

Alani is not an emergency service and nobody is watching it around the clock. If you are in danger now, call or text 988 for the Suicide and Crisis Lifeline, or call 911. The full Medical and Crisis Disclaimer is part of these terms.

3. Who can use Alani

You must be at least 18 years old. If you are not, please do not use Alani or send us anything about yourself.

You may hold one account. Keep it to yourself, and tell us at legal@alanijonesfoundation.org if you think somebody else has got into it.

4. What Alani costs

Nothing. Alani is free, and we do not intend to charge for it. We do not take payment for the app, for the readings, for the peer support, or for a comfort box.

5. Donations

Donations are voluntary and are processed by Zeffy on their own pages, under their own terms. We never receive your card details.

Donations are generally not refundable, though if you gave by mistake, write to us and we will try to put it right. We are a nonprofit organization and gifts are tax deductible to the extent the law allows, but we are not able to give you tax advice and you should not treat anything here as such.

6. Comfort boxes and other things we send

If we send you a comfort box or a keepsake, it is a gift. It holds ordinary keepsake goods. It is not a medical device, it is not sterile, and it is not for clinical use.

We will do our best to send what you asked for to the address you gave us, and we cannot promise a date. Supplies are limited and we may not be able to fulfil every request.

7. What you write, and what we may do with it

What you write stays yours. We claim no ownership of your journal, your posts, your photographs or anything else you put into Alani.

Your journal. We take no licence over it at all. We store it so that you can read it back and so that a lost phone does not lose it, and that is the only reason we hold it. We do not publish it, quote it, show it to anyone else, or use it to make anything. Photographs you add stay on your phone and never reach us.

What you post to the peer feed. Other parents need to be able to read it, so for that content you give us permission to store it, show it to other people using Alani, and back it up. That permission exists only so the feed works. It ends when you delete the post, apart from copies already in a backup, which fall away on their own, and any copy somebody else has already saved.

If we ever want to quote you, in a report, a grant application or anything public, we will ask you first and you are free to say no.

You are responsible for what you write, and you confirm you have the right to share it.

8. The peer support space

Posting in the peer feed means agreeing to the Community Guidelines, which are part of these terms. They set out what is welcome, what is not, and how reporting and blocking work.

We can remove content and restrict or end accounts under those guidelines. Anything you post to the feed can be read by other people using Alani, so treat it as public.

9. Using Alani properly

Please do not:

• break the law with it, or use it to harm somebody
• collect other parents' information, or contact them off Alani after being asked not to
• advertise, sell, fundraise, or recruit for a study or a service
• pretend to be somebody else, or to speak for the Foundation
• attack, overload, scrape or reverse engineer it, or work around its security
• upload anything malicious

10. Our content

The readings, the writing, the design, the name and the logo belong to the Foundation or to the people we licensed them from. You may read and use them for yourself. Please do not republish or sell them, or use our name or logo to suggest we endorse something, without asking us.

Copyright complaints are handled under the Copyright Policy.

11. The app itself

We give you permission to install and use the Alani app on devices you control, for yourself. That permission is not transferable and we can end it if these terms are broken.

If you got the app from the Apple App Store, then: these terms are between you and the Foundation and not with Apple; Apple has no obligation to support or maintain the app; if the app fails to conform to any applicable warranty you may tell Apple and Apple may refund the purchase price, which is nothing, and Apple has no other warranty obligation; the Foundation, not Apple, is responsible for any claim about the app, including product liability, any failure to meet a legal requirement, and any claim under consumer protection or privacy law; the Foundation, not Apple, is responsible for investigating and resolving any claim that the app infringes somebody's intellectual property; you confirm you are not in a country subject to a US embargo or on a US prohibited party list; and Apple and its subsidiaries are third party beneficiaries of this section and may enforce it.

12. Other people's services and links

Alani links to crisis lines, support organizations and other resources we did not write and do not run. We list them because they may help. We do not employ them, supervise them, check their credentials or take responsibility for them, and a listing is not a recommendation.

13. Ending it

You can stop using Alani whenever you like, delete the app, and ask us to delete your account by writing to legal@alanijonesfoundation.org.

We may suspend or end an account that breaks these terms or the Community Guidelines, or where we need to in order to protect somebody. Except where somebody is at risk or the law requires otherwise, we will tell you and give you a way to respond.

Sections 7, 14, 15, 16 and 17 continue to apply afterward.

14. No warranty

Alani is provided as it is. We do not promise that it will always be available, that it will be free of faults, that a notification will arrive, or that anything in it will help. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing here limits any right you have that cannot lawfully be limited.

15. Limits on liability

To the extent the law allows, the Foundation is not liable for indirect, incidental, special or consequential loss, or for lost data. Our total liability for any claim relating to Alani is limited to one hundred dollars.

These limits do not apply to death or personal injury caused by our negligence, to fraud, or to anything else the law does not permit us to limit.

16. Indemnity

If your misuse of Alani, or something you posted, leads to a claim against the Foundation, you agree to cover the reasonable cost of dealing with it. This does not apply to a claim arising from something we did.

17. Governing law, and where a dispute is heard

These terms are governed by the laws of the State of Indiana, without regard to conflict of law rules.

If we cannot sort something out between us, it goes to the state and federal courts located in Indiana, and we both agree those courts may hear it. Neither of us is required to arbitrate. Nothing stops you bringing a claim in small claims court, or complaining to a regulator.

18. Changes to these terms

We may change these terms. When we do, we will change the date at the top, and if the change is a significant one we will tell you rather than leave you to find it. Carrying on with Alani after a change means accepting the new terms.

19. The rest

If part of these terms turns out to be unenforceable, the rest still stands. If we do not enforce something straight away, we have not given up the right to. You may not transfer your rights under these terms; we may transfer ours to a successor organization carrying on this work.

These terms, together with the Privacy Policy, the Community Guidelines and the Medical and Crisis Disclaimer, are the whole agreement between us about Alani.
